Giveaways
What Florida and Meta ask of a giveaway
In Florida, a giveaway with a prize and a random draw that promotes what you sell is a game promotion. The law does not let you require a purchase, a payment or an entry fee to enter.
Above $5,000.00 in prizes, you also file the rules with Florida’s Department of Agriculture and Consumer Services before the start, and report the winners after the draw.
Meta adds its own rules. On Facebook, a giveaway cannot ask for or reward shares, reposts or tags of other people. On Instagram, nobody may be asked to tag themselves in a photo they are not in.
On both, each entrant releases the platform and accepts that it does not sponsor or run the giveaway. A giveaway is a new offer, so it waits for your sign-off like any other.

Licensed trades
For a licensed business, a post that sells is an ad
Florida asks some licensed businesses to show a detail in every ad. For contractors the rule covers any medium, and the Florida Bar’s rules name social networking outright.
So a post that promotes a remodel, a listing or a treatment carries that detail, as a printed flyer would.
Law firms also have a rule for two languages. The words the Bar requires appear in the language of the ad, and in both when the post uses English and Spanish.
Send us your license details before the first post. Next month’s calendar reaches you before the 25th, so you see every post that advertises your work before it goes out.

A contractor who leaves the number off gets a notice. If it is not fixed within 30 days, a fine can follow.

A gift to a creator still needs a disclosure
If you invite a creator for a free meal or a free treatment, the Federal Trade Commission counts the gift as a connection the post must disclose. That holds even if you never asked for a post.
The disclosure goes with the post itself, where people can’t miss it, and in the post’s own language. A creator who posts in Spanish discloses in Spanish.
Meta also requires its paid partnership label on branded content, and a gifted product can count. The FTC adds that a platform’s tool alone may not be enough.
When the disclosure is missing, your business can be liable too. The FTC expects you to tell the creator to disclose, so put it in writing before the visit.
- Free meal, product or treatment
- A connection the post discloses
- Where
- With the post itself, not lost among hashtags
- In a reel
- In the video, not only in the caption
- Language
- The same as the post
- On Meta
- The paid partnership label, plus the creator’s own words
- If it is missing
- Your business can be liable

What Miami owners ask about their pages
How much does social media management cost in Miami?
With us, Starter costs $950.00 a month for 8 posts on Facebook and Instagram, with no setup. Replies to comments and messages cost $750.00 a month if you are not on Pro. Growth and Pro add TikTok and a monthly shoot at your business, and we give you their price on the call. No plan has a minimum term.
Comparing it with a scheduling tool or a hire on staff? Our article has what each option costs:
How much social media management costsIs this the same as hiring a community manager?
Close. A community manager posts for you and answers the people who write in. With us, posting is in every plan, and answering comes with Pro or with the Comments and messages extra: Monday to Friday, 9:00 AM to 6:00 PM, within 4 business hours, up to 300 replies a month.
Can you buy followers or likes for my page?
No. Since October 21, 2024, an FTC rule bans buying fake followers, views or likes, such as those made by bots or hijacked accounts. It applies when the buyer knew or should have known they were fake. It covers the sellers too, and the FTC can seek civil penalties.
Do you answer comments in Spanish?
Yes. We are one team for your customers in English and in Spanish, and we write each language for its own reader. 67% of Miami-Dade residents age 5 and over speak Spanish at home. Replies come with Pro, or as the Comments and messages extra for $750.00 a month.
Are the replies written by AI?
Some start as an AI draft, and a person on our team reads each one before it goes out. If AI helped write a reply, the reply says so. Replies in Spanish are written in Spanish, not translated from the English one.
